“Impact of BNSS Laws on the Common Citizens: A Human Rights Perspective”
By Gurpreet Singh Panesar, Human Rights & Social Welfare Activist | LCIF Coordinator | Legal Awareness
Introduction
India’s legal framework is undergoing significant transformation with the introduction of the Bharatiya Nagarik Suraksha Sanhita (BNSS), replacing the Criminal Procedure Code (CrPC). As a human rights and social welfare activist, I believe it is crucial to understand how such legal changes affect the rights, dignity, and day-to-day life of the common citizen.
1. Understanding the BNSS
The BNSS aims to modernize the criminal justice process, emphasizing swift trials, digital evidence, and accountability. However, there are concerns about whether the implementation respects fundamental rights enshrined in the Constitution.
Key features include:
Mandatory timelines for investigation and trial
Introduction of zero FIR
Digital documentation of witness statements
Enhanced police powers in preventive detention
2. Human Rights Concerns
While efficiency in justice is welcomed, we must question:
Are marginalized communities aware of their new rights under BNSS?
Could increased police powers lead to misuse and custodial violence?
What safeguards exist to protect the presumption of innocence?
Gurpreet Singh Panesar emphasize the need for transparency, legal literacy, and community monitoring to ensure the BNSS does not compromise liberty in the name of law and order.
3. Role of Human Rights & Social Welfare Activists
Activists play a pivotal role in:
Legal awareness campaigns in slums and villages
Training paralegal volunteers to help citizens understand their rights
Filing PILs (Public Interest Litigations) against misuse of preventive detention
Advocating for fair compensation and rehabilitation for victims of legal abuse
4. Recommendations for a Balanced Approach
Independent Oversight Committees to review police actions under BNSS
Legal Aid Cells at district level to ensure access to justice
Human Rights Commission involvement in monitoring implementation.
Conclusion– As India progresses toward a digitally-driven justice system, it is our collective duty to ensure that laws like the BNSS strengthen—not weaken—our commitment to justice, equality, and human dignity. I urge policymakers, civil society, and citizens to come together in making the BNSS a tool of empowerment, not oppression.
Mr. Gurpreet Singh Panesar is widely recognized for his relentless dedication to human rights and social welfare, actively working since 2012 to combat injustice, torture, and deprivation. His efforts have consistently focused on supporting the underprivileged and voicing the concerns of the marginalized.
We are honoured by his presence and continued inspiration in the fight for justice and social betterment.
🧭 Conclusion by Gurpreet Singh Panesar
“Building a just and humane society demands synergy between social service systems, legal frameworks, and grassroots activism. Through informed, ethical, and empowered citizenry, we can ensure equal dignity and justice for all.”
